CONCERNING
STIPULATION OF THE EXPORT REFERENCE PRICES (HPE) OF CERTAIN EXPORT GOODS
THE MINSTER OF TRADE OF REPUBLIC INDONESIA,
Attachment
Considering:
- a. that in order to implement the provision in Article 3 paragraph (6) of Government Regulation No. 35/2005 regarding export levies on certain exported goods, it is necessary to stipulate a regulation of the Minister of Trade on Stipulation of export check prices of certain exported goods;
- b. that in relation thereto, it is necessary to issue a regulation of the Minister of Trade;
In View of:
- 1. Trade Ordinance of 1934 (Statue Book of 1938 No. 86);
- 2. Law No. 10/1995 on Custom Affairs (Statue Book of 1995 No. 75, Supplement to Statue Book No. 3612) as has already been amended by Law No. 17/2006 (Satue Book No. 2006/1993, Supplement to statue Book No. 4661)
- 3. Law No. 20/1997 on non-tax state revenue (Statue Book of 1999 No. 30, Supplement to Statue Book No. 3888);
- 4. Government Regulation No. 35/2005 on exported goods (Statue Book of 2005 No. 82, Supplement to Statue Book No. 4531);
- 5. Presidential Decree No. 260/1967 on affirmation of the tasks and responsibilty of the Minister of Trade in the foreign trade sector;
- 6. Presidential Decree No. 187/M/2004 on the establishment of the United Indonesia Cabinet as has already been amended several times and the latest by Presidential Decree No. 171/M/2005;
- 7. Presidential Regulation No. 9/2005 on the status, tasks, functions, organizational structures and working arrangements of state ministries of Republic of Indonesia as has already been amended several times and the latest by Presidential Regulation No. 94/2006;
- 8. Presidential Regulation No. 10/2005 on first-echelon organizational units and tasks of state ministries as has already been amended several times and the latest by Presidential Regulation No. 17/2007;
- 9. Decree of the Minister of Industry and Trade No. 558/MPP/KEP/12/1998 jo. Regulation of the Minister of Trade No. 01/M-DAG/PER/1/2007 on export general provisions;
- 10. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 on the Organization and working Arrangement of the Ministry of Trade as has already been amended several times and the latest by Regulation of the Minister of Trade No. 22/M-DAG/PER/2007;
- 11. Regulation of the Minister of Trade No. 25/M-DAG/PER/12/2005 on procedures for stipulation of export check prices of certain exported goods;
- 12. Regulation of the Minister of Trade No. 59/M-DAG/KEP/3/2006 dated March 29, 2006 on the Establishment of the Team for Stipulating Export Check Prices (HPE) of Certain Exported Goods.
Observing:
Result of the Coordinating Meeting with Related Institutions and Associations on June 29, 2007 regarding Stipulation of HPE of Certain Exported Goods in the July 10, 2007-August 9, 2007 period.
HAS DECIDED:
To Stipulate:
THE REGULATION OF THE MINISTER OF TRADE ON STIPULATION OF EXPORT CHECK PRICES (HPE) OF CERTAIN EXPORTED GOODS
Article 1
The Minister in charge of trading affairs or the appointed official in this case the Director General of Foreign Trade shall stipulate Export Check Prices (HPE) of certain exported goods every month.
Article 2
HPE as intended in Article 1 shall be stipulated by referring to international average prices and/or FOB average prices at seaports in Indonesia in one month before the stipulation of HPE.
Article 3
The amount of HPE of timber, rattan, coal, oil palm, crude palm oil and their derivative products and leather shall be as contained in the attachment to this regulation.
Article 4
HPE as set forth in Article 3 shall be the basis for calculating export levies (PE).
Article 5
HPE as meant in Article 3 shall apply for one month, starting from July 10, 2007 - August 9, 2007.
Article 6
In the case of the validity period of HPE stipulated on the basis of this regulation already expiring and new HPE being not yet stipulated, HPE as contained in the attachment to this regulation shall remain effective as the basis for calculating PE until new export prices are stipulated.
Article 7
With the enforcement of this regulation, the Export Check Prices (HPE) a contained in the Attachment to regulation of the minister of trade No. 24/M-DAG/PER/5/2007 on stipulation of Export Check Prices (HPE) of certain Exported Goods shall be declared null and void.
For public cognizance, it is ordered that this Minister of Financeshall be published by placing in state gazette of the republic of Indonesia.
